The defendant should make a breach of that duty of care that was owed to him; the breach should have resulted in some damage to the plaintiff; and the damage that is caused should not be remote in nature (Oberdiek, 2013). However, it should also be noted that there are certain defenses that can be taken by the defendant whenever a suit of negligence is initiated against him (Bolton v Stone, [1951]). These defenses are also substantiated under the Civil Liability Act in Australia. Under section 23 of the Act, it contributory negligence is proved in any matter, then the liability of the defendant comes down substantially (Fletcher, 2008). Intoxication is one of the grounds that can attract a presumption of contributory negligence under Section 5 of the Civil Liability Act (Salmond, 2011). The court has the powers to reduce the damages by 100% in such instances. However, it should be noted that the courts determine the question of contributory negligence by facts (Charlesworth and Percy, 2012). There are two stages involved in this process. While the first determines the negligence on the part of the plaintiff, on the second level, a percentile value is assigned to the same (Marcolongo v Chen, [2011]). Further, Under Section 16 and 17 of the Civil Liability Act, obvious risks and voluntary assumption of risk have been substantiated to be grounds of negligence. It has been stated that only if a person can prove that he was unaware of the risk, then can he say that there was no contribution towards the risk (Hobartlegal.org.au, 2016). Also, if a person understands that there is an obvious risk in any matter, then the same should be seen from the perspective of a reasonably prudent person and the knowledge of the presence of such risk. It substantiates a claim that the plaintiff himself is responsible for negligence, and the defendant is not liable in the matter (Cooke, 2007). Application The above-discussed rules shall now be applied in the given scenario and then an analysis of the same shall be made. Michele and Rebecca were drunk. But at the same time, it is also being argued here that Rebecca had a liability of contributory negligence in the matter because, in spite of knowing that Michelle was not competent to drive on that night, she chose to take the ride. Moreover, the risk that is associated with the matter is very obvious, and the acceptance of the risk by Rebecca also indicates the voluntary acceptance of the risk by her. Any prudent and reasonable person would have understood the risk that is being inflicted when Michelle is executing the act of drunk driving, and even then Rebecca herself acceded to the risk. This also substantiates the contributory negligence on the part of Rebecca that is being argued in the matter. Eventually, the car met with an accident, and Rebecca underwent several injuries including a broken leg. In such circumstances, even if Rebecca asks for compensation from Michelle for her injuries, those claims cannot be substantiated because of her contribution to the negligence of Michelle. The stimuli should consist of passport photographs taken from the front. They should have the black and white shade and categorized according to gender. The person preparing this test should ensure that none of these people has unique physical characteristics such as long hair, different style of clothing or even eye glasses. The other recommendation is that half of this population should consis t of one race and the other half the other race under consideration. Visual basic software is then used to describe these images to the people participating in the experiment. Past When BP records began, the UK was getting 98% of its primary energy from burning fossil fuels like oil, natural gas and coal mainly due to the increasing transportation and power generation sectors.Pre-1976, the UK was a large importer of oil due to the fact there were very few known oil sources that could be used domestically. In the following years North Sea oil was discovered and production got underway, meaning the UK could gradually reduce their imports and rely more on domestic oil. Within a few years, in 1981 the UK had become a net expor ter of oil showing that at this time there was no major issue with energy security but instead that there was a surplus and a chance to make some money. The use of natural gas in the UK did not get started until 1968 and production was thriving for 30 years ntil its peak in 2000 and then saw a gradual decline. The UK imported very little gas, and most of the gas produced from the North Sea was consumed in the UK and only for a brief period did the UK actually export natural gas. During the peak times of natural gas production, it was introduced as a replacement for coal for home heating and power generation as itââ¬â¢s a much cleaner source of energy and could help to reduce the air pollution in cities. Up until 1995 the UK imported some natural gas from Holland and Norway which could also be an important connection for the future.In the 60s, coal was the UKs main source of primary energy, accounting for around 60% of the daily consumption, but by 1999 this number had declined to just 16%, showing how the UK had found other sources of energy giving a much larger diversity to their energy consumption. If you were to give the UK a score for the energy security index for this period, it would probably be a similar score to today but for different reasons. It is estimated that there are still 20 billion barrels of oil available to exploit, but there is a worry that in the competitive market, investment is likely to go to other places in the world and this oil could go to waste. There is hope that drilling in the Falkland Islands will produce enough oil to pay-off the billion pound deficit. The UK is also having serious problems with coal and gas production which is leading to even more imports. We have once again become a net importer of both fuels, and as the marke t becomes more competitive these fuels will sell themselves to the highest bidders meaning that everyone in the UK will have to start paying more for their energy. Many people are starting to question why we do not use more renewable energy sources like wind, solar or nuclear energy.Critics say that we shouldnââ¬â¢t rely on wind energy because of its intermittent nature and it would make more sense to spend the money on improving nuclear technologies. Professor MacKay believes we need to invest more money into renewable and blames the public, for rejecting proposals of wind farms and nuclear power plants while demanding a unchanged lifestyle, for the possible energy problems. He also says how he thinks the blackouts could be the only way to get people to realise that we need to invest in modern nuclear technology and other clean sources of energy, rather than relying on the limited supplies of coal, oil and gas.In another report, written by Ian Fells (a professor at the University of Newcastle), the point about the blackouts was reinforced and the extent to which it could cause huge problems for the UK was made evident when he said ââ¬ËWe had a power cut in 2003 for about 12 hours in the City of London ââ¬â the consequential loss w as about ? 700m because everything stops. But not all ceremonies were secret rituals; in fact, many were public rituals, theatrical performances and dances played in public arenas to unite communities and express political power relationships. Recent investigations of public ceremonialism by University of Arizona archaeologist Takeshi Inomata reveal the importance of these public rituals, both in the architectural changes made in the Maya cities to accommodate the performancesà and in the political structure which developed alongside the festival calendar. Mayan Civilization The Maya is a name given to a group of loosely associated but generally autonomous city-states, each led by a divine ruler. These small states were spread throughout the Yucatà ¡n peninsula, along the gulf coast, and into the highlands of Guatemala, Belize, and Honduras. Like small city centers anywhere, the Maya centers were supported by a network of farmers who lived outside the cities but were held by allegiances to the centers. At sites such as Calakmul, Copà ¡n, Bonampak, Uaxactun, Chichen Itza, Uxmal, Caracol, Tikal, and Aguateca, festivals took place within the public view, bringing together the city residents and the farmers and reinforcing those allegiances. Festivals of the Maya Many of the Mayan festivals continued to be held into the Spanish colonial period, and some of the Spanish chroniclers such as Bishop Landa described festivals well into the 16th century. Three types of performances are cited in the Maya language: dance (okot), theatrical presentations (baldzamil) and illusionism (ezyah). Dances followed a calendarà and ranged from performances with humor and tricks to dances in preparation for war and dances mimicking (and sometimes including) sacrificial events. During the colonial period, thousands of people came from all around northern Yucatà ¡n to see and participate in the dances. Music was provided by rattles; small bells of copper, gold and clay; tinklers of shell or small stones. A vertical drum called the pax or zacatan was made of a hollowed tree trunk and covered with an animal skin; another u- or h-shaped drum was called the tunkul. Trumpets of wood, gourd, or conch shell, and clay flutes, reed pipes and whistles were also used. Elaborate costumes were part of the dances as well. Shell, feathers, backracks, headdresses, body plates transformed the dancers into historical figures, animals, and gods or other-worldly creatures. Some dances lasted all day, with food and drink brought to the participants who kept dancing. Historically, preparations for such dances were substantial, some rehearsal periods lasting for two or three months, organized by an officer known as a holpop. The holpop was a community leader, who set the key for the music, taught others and played an important role in festivals throughout the year. Audiences at Mayan Festivals In addition to Colonial period reports, murals, codices, and vases illustrating royal visits, court banquets, and preparations for dances have been the focus for archaeologists to understand the public ritual which predominated the classic period Maya. But in recent years, Takeshi Inomata has turned the study of ceremonialism at Maya centers on its head---considering not the performers or the performance but rather the audience for the theatrical productions. Where did these performances take place, what architectural properties were constructed to accommodate the audiences, what was the meaning of the performance for the audience? Inomatas study involves a closer look at a somewhat less-considered piece of monumental architecture at classic Maya sites: the plaza. Plazas are big open spaces, surrounded by temples or other important buildings, framed by steps, entered via causeways and elaborate doorways. Plazas in Maya sites have thrones and special platforms where performers acted, and stelae---rectangular stone statues such as those at Copà ¡n---representing past ceremonial activity are also found there. Plazas and Spectacles Plazas at Uxmal and Chichà ©n Itzà ¡ include low square platforms; evidence has been found in the Great Plaza at Tikal for the construction of temporary scaffoldings. Lintels at Tikal illustrate rulers and other elites being carried on a palanquin--a platform on which a ruler sat on a throne and was carried by bearers. Wide stairways at plazas were used as stages for the presentations and dances. The plazas held thousands of people; Inomata reckons that for the smaller communities, nearly the entire population could be present at once in the central plaza. But at sites such as Tikal and Caracol, where over 50,000 people lived, the central plazas could not hold so many people. The history of these cities as traced by Inomata suggests that as the cities grew, their rulers made accommodations for the growing populations, tearing down buildings, commissioning new structures, adding causeways and building plazas exterior to the central city. These embellishments indicate what a crucial part performance for the audience was for the loosely structured Maya communities. While carnivals and festivals are known today throughout the world, their importance in defining the character and community of governmental centers is less considered. As the focal point for gathering people together, to celebrate, prepare for war, or watch sacrifices, the Maya spectacle created a cohesion that was necessary for the ruler and common people alike. This can be done through two different ways, whereby the tissues can be rapidly frozen while the sections sliced using a cryostat microtome in the freezing chamber. Upon receiving the specimen, then fixation is the crucial stage that follows in the laboratory. Fixation is a critical stage when it comes to preparing specimens for microscopic examination.
